Terms of Use

1. About this platform

Nepalese in NewZealand (“the platform”, “we”, “us”) is a free, community-run website operated by volunteers for the benefit of Nepalese people living in Aotearoa New Zealand. It provides a space to:

• Browse and post room listings
• Browse and offer community services
• Connect with other community members

By accessing or using this platform, you agree to these Terms of Use. If you do not agree, please do not use the platform.

2. Eligibility

You may use this platform if you:

• Are at least 18 years of age
• Are capable of forming a legally binding agreement under New Zealand law
• Provide accurate and truthful information when registering or creating listings

We reserve the right to suspend or terminate any account that does not meet these requirements.

3. Your account

• You are responsible for keeping your account credentials secure.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorised access to your account.
• You may only hold one account. Creating duplicate or fake accounts is prohibited.

4. Room listings

If you post a room listing, you confirm that:

• You have the legal right to list the room (i.e. you are the owner, tenant with subletting permission, or authorised agent).
• All information in the listing — including address, price, photos, and availability — is accurate and not misleading.
• You will not discriminate against prospective tenants on grounds prohibited by the Human Rights Act 1993 (e.g. race, ethnicity, religion, sex, disability).
• You understand that all room arrangements, tenancy agreements, payments, and disputes are solely between you and the other party. We are not responsible for any aspect of those arrangements.

Listings are subject to admin review before going live. We may remove listings at our discretion, without notice, if we believe they violate these terms or are otherwise inappropriate.

5. Service listings

If you post a service listing, you confirm that:

• You have any licences, qualifications, or permissions required by New Zealand law to perform the service.
• All information — including the nature of the service, pricing, and contact details — is accurate and not misleading.
• You accept that contact details you add to a service listing will be visible to the public (without login required).
• All service arrangements, payments, and disputes are solely between you and the client. We are not responsible for any aspect of those arrangements.

6. User conduct

You agree not to use the platform to:

• Post false, misleading, or fraudulent listings or information
• Harass, threaten, or abuse other users
• Spam or send unsolicited messages
• Scrape, copy, or reproduce platform content without permission
• Attempt to gain unauthorised access to any part of the platform
• Violate any New Zealand law or regulation
• Post content that is defamatory, discriminatory, sexually explicit, or otherwise harmful

We reserve the right to remove content or suspend accounts that violate these rules, without prior notice.

7. Platform disclaimer and limitation of liability

We are a notice board, not a party to any transaction. Nepalese in NewZealand does not:

• Verify the identity, credentials, or trustworthiness of any user
• Inspect, assess, or guarantee the accuracy of any listing
• Endorse any service provider, host, or tenant
• Mediate, arbitrate, or take responsibility for disputes between users
• Guarantee uninterrupted or error-free access to the platform

To the maximum extent permitted by New Zealand law, Nepalese in NewZealand and its volunteers shall not be liable for any loss or damage — including financial loss, property damage, personal injury, or any indirect or consequential loss — arising from your use of the platform or any arrangement made through it.

Nothing in these terms limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.

8. Intellectual property

Content you post (listings, photos, descriptions) remains yours. By posting it, you grant us a non-exclusive, royalty-free licence to display it on the platform for as long as it is published.

The platform's own content, design, and code is the property of Nepalese in NewZealand. You may not reproduce or distribute it without permission.

9. Third-party links and services

The platform may link to external websites (e.g. WhatsApp, Google Maps). We are not responsible for the content, privacy practices, or reliability of any third-party service.

10. Reporting concerns

If you encounter a listing or user you believe is fraudulent, unsafe, or in breach of these terms, please report it using the feedback widget on the platform or by emailing us at hello@nepaleseinnewzealand.co.nz. We take reports seriously and will investigate promptly.

11. Changes to these terms

We may update these terms at any time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the platform after changes constitutes acceptance of the new terms.

12. Governing law

These terms are governed by the laws of New Zealand. Any disputes arising from the use of this platform shall be subject to the exclusive jurisdiction of the New Zealand courts.
